SMS Terms & Conditions
The United States Playing Card Company, including its subsidiaries and affiliates, (collectively, “USPC”, “we,” “us,” or “our”) provides these SMS Terms and Conditions (the “SMS Terms”), which govern the provision and delivery of text messages by us or our text message service providers to you (each a “USPC SMS Program”). USPC provides USPC SMS Programs to provide you with marketing or informational text messages. By signing up or otherwise opting into a USPC SMS Program, you agree to these SMS Terms.
1 Signing Up for a USPC SMS Program:
You may subscribe to a USPC SMS Program by signing up through our Services. For example, if you register for an account, we might send you a verification code or confirmation message. You may also sign up for or initiate other text message communications, such as by initiating an SMS chat session with us. By signing up or otherwise opting into a USPC SMS Program, you:
Authorize us to use an automatic telephone dialing system to send recurring text messages to the mobile phone number associated with your opt-in (i.e., the number listed on the opt-in form or, if none, the number from which you send the opt-in, or, if none, the number on file for the account associated with your opt-in).
Acknowledge that you do not have to consent to receive promotional text messages as a condition of purchasing goods or services.
Consent to the use of an electronic record to document your opt-in.
While you consent to receive messages sent using automated technology, these SMS Terms shall not be interpreted to suggest or imply that we send any or all of our text messages using an automatic telephone dialing system (or other automated technology, as defined under applicable laws).
2 Costs
Message and data rates may apply, so depending on your plan with your wireless or other applicable provider, you may be charged by your carrier or other applicable provider. Please consult your service agreement with your wireless carrier or contact your wireless carrier to determine your phone’s pricing plan and the charges for sending and receiving text messages. You acknowledge that you are responsible for any message, data, or other charges incurred (usage, subscription, etc.) as a result of participating in a USPC SMS Program.
3 Frequency of Text Messages
We may send you an initial message confirming that we have received your opt-in. After that, the specific amount of text messages may vary depending on how you use our services and whether you take steps to generate additional text messages from us (such as by sending a HELP request or initiating SMS coaching sessions).
4 Participating Carriers
Our text messages can be sent through all major carriers. The content may not be compatible with all mobile device models. Participating carriers may be changed at USPC’s sole discretion without prior notice. USPC will not be liable for any delays in the receipt of any text messages or changes to the participating carriers as delivery is subject to effective transmission from your carrier with active participation at that time. The mobile carriers are not liable for delayed or undelivered messages.
5 Eligibility
By signing up to a USPC SMS Program, you represent that you are 18 years of age or older and understand the obligations and agree to the terms set forth in these SMS Terms, which forms a binding agreement between you and us. You further represent that you are the subscriber of the cellular service at the mobile number provided. In the event that you change or deactivate the mobile number you enrolled in the USPC SMS Program, you agree you will promptly notify USPC at support@cardtopia.com to have your number removed and/or updated.
6 Opting Out of a USPC SMS Program and Seeking Assistance
Depending on the USPC SMS Program(s) you have opted into, you may receive text messages from different originating phone numbers. To opt out of a USPC SMS Program, reply STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE to any of the text messages you have received from USPC.. Opting out of one USPC SMS Program will not opt you out of other USPC SMS Programs you are enrolled in. After opting out, we may send you confirmation of your opt-out via text message.
If you need assistance at any time, please text HELP in response to one of our text messages.
7 Modifications to these SMS Terms
We reserve the right to modify these SMS Terms, or any part thereof, or add or remove terms at any time, and such modifications, additions or deletions will be effective immediately upon posting. Your continued enrollment in a USPC SMS Program shall be deemed to constitute acceptance by you of such modifications, additions or deletions.
